Policeman killed, 3 injured in shootout near Bulgaria school
A policemen was killed and three were injured Friday in Bulgaria in a shootout with a gunman who threatened staff and pupils at a school in the central town of Lyaskovets.
"The man was arrested, injured but alive. The operation is over," Interior Minister Tsvetlin Yovchev told parliament.
Petko Savov, 53, who was registered as suffering from a personality disorder, had barricaded himself in his flat opposite the Maksim Raykovich elementary school and opened fire on special police forces who had come to arrest him early Friday, officials said.
Police had initially come to question the man over a series of notes he had sent to the director of the school, threatening him, the teachers and the pupils.
"He said there was a lot of noise from the school, disturbing him and his mother, adding that he was a hunter and things would end badly," school director Nikolay Kozhuharov told BNR radio.
Media reports said the man, who was unemployed and has not left his flat since 2011, had two hunting carbines and two other rifles but his weapon permit had expired years ago.
“The man has been arrested; in practice the operation is over. The man was wounded within the course of the operation”, Deputy Prime Minister and Minister of Interior Tsvetlin Yovchev said at the parliament in connection with the case in Lyaskovets, a reporter of FOCUS News Agency announced.
“During the police operation in the town of Lyaskovets was killed an officer of the squad to combat terrorism. Three more officers have been injured. Their life is out of danger. One of them underwent specialized medical intervention,” Tsvetlin Yovchev said.
"On March 12, it was received a signal for made threats against students if they continue to make noise. On March 13, the case was discussed at the Supreme Prosecutor's Office of Cassation and was taken a decision for urgent actions. The decision was made due to several reasons - the information available about the person by the moment - in 2011 the person was registered suffering antisocial problems such as non- leaving the house and demonstrating an extremely high level of aggression towards other people denying any form of dialogue," Minister Yovchev stated.
"He had possessed legal firearm - a total of 4 pieces. In 2012, the permit for the possession of the arms expired. There was a police operation under preparation involving squad to combat terrorism. The Special Forces had to forcibly break into the home of the man and to seize the gun. There were psychologists on site. It was decided that operation to be cancelled. Given the direct threat that the man may use weapons against students motivated the decision, which was taken later," the Deputy Prime Minister specified.
The three police officers who were injured in a shooting with a civilian in the town of Lyaskovets are in stable condition. Two of them have more serious injuries. That is what Dr. Stefan Filev from the hospital for active treatment in the town of Veliko tarnovo announced for Radio FOCUS Veliko Tarnovo.
Two of the patients underwent surgery .They suffer injuries in the limbs. The third one is in better health condition. There is no threat for the life of the injured police officers.
According to information from the hospital the three injured were taken to the hospital at around 6:00 am.
Later today ambulances transported the three victims of the shootout in Lyaskovets at the Military Medical Academy (MMA) in Sofia, the press office of MMA announced. According to the initial reports of the medical team, which transported the wounded officers from Veliko Tarnovo to the capital, the three men suffer gunshot injuries of the upper limbs. They are in stable condition.
Emil Sharkov is the officer from the squad for combating terrorism who was killed within the course of today’s specialized operation in the town of Lyaskovets, the Secretary General of the Interior Ministry Chief Commissioner Svetozar Lazarov said at a news conference.
Commissary Lazarov expressed his condolences to the family of the killed police officer and told them that they were friends.
District Prosecutor's Office - Veliko Tarnovo has initiated a pre-trial proceedings against Petko Petkov for murdering a police officer, the press office of the Prosecutor's Office announced. There are ongoing intensive investigative actions, questioning of witnesses, inquests of the crime scene, making expertises. The perpetrator was detained by the Interior Ministry.

Acting in their capacity of partners under the project: “Social Dialogue: the most important tool for socially responsible reforms”, and of organizations representing employees in the security sector in Bulgaria, Serbia and the Netherlands,
HAVING REGARD TO
- the growing significance and need of developing the social dialogue in the field of public order and security protection in European countries;
- the tendencies in the development of national and international trade unions of the employees in the security sector;
- the need for development of key skills for participation in the social dialogue on national and European level;
- the established good practices and lessons learned during the project “Social Dialogue: the most important tool for socially responsible reforms”,
HAVE AGREED AS FOLLOWS
To continue their collaboration and to develop the social dialogue at European level as members of the European Police Union /EPU/ by making coordinated efforts jointly and severally:
1. To create a single database of national and European legislation concerning the rights of the employees in the security sector, executed in the English language.
2. To increase the capacity of the European social partners for conducting social dialogue by sharing training materials and handbooks prepared by the national trade unions.
3. To unite around single principles and procedures for conducting the social dialogue and participating in the decision-making and policy-making process.
4. To create a roadmap for the issues in conducting the social dialogue at national and European level and ways of solving them.
5. To prepare an integrated strategy for the development of key competences for conducting the social dialogue at national and European level and to establish a European trade union academy in the security sector.
6. To establish minimum standards at European level for all employees in the security sector in terms of their education and professional training, equipment and facilities, and the salary they receive.
7. To create a mechanism for using the expertise of international partners for solving problems at national level and to introduce integrated rules and procedures for conducting the social dialogue at national and European level which will allow for intervention of international social partners in settling disputes.

DEMANDS OF TUFEMI
Increasing of the basic salaries of employees in MI at least 25%
The main motive of unionists is that "such an increase would in certain extent compensate the reduction of the income of employees as a result of inflationary pressures and a lack of real wage increases and any additional bonuses or incentives in recent years." TUFEMIs representatives are reminding such increasing of the wages was expected at the end of 2008, when officially had been said by the MoI officials to employees that "wages are low" and "wages in the Ministry of Interior must be adequate to the working conditions".
Legislative amendments that will:
2.1. Give a definition and to fill with a real meaning the term "physical integrity " - Art. 5a. of the Law for MoI, the physical integrity could be defined as a legal prohibition to enter into physical contact with a police officer. Exceptions are cases where it is necessary assistance to be obtained. Such definition, supported by appropriate administrative and criminal provisions, will restrict attacks on officials in the performance of his/her duties and will be punished to a fine ranging from 200 to 300 leva.
2.2. Change of the term "incompatible with the MoI service" - Art. 177 of Law for MoI.
TUFEMI insists on MoI officers to be allowed to receive income from activities other than their employment in the MoI on the procedure determined by the Minister. This proposal is prompted by the bad physical condition of the employees and the fact that in recent years the situation of employees in the system has worsened. TUFEMI is reminding to the Minister that there are many good practices in other EU Member States where the additional income and second job is a policy of the Government policy and it is under Governmental regulations.
2.3. Remov e the ability for overtime work beyond the amount of compensation subject of Art. 211-212 of L aw for M o I.
TUFEMIs observation of this problem shows it is caused by the fact that in the Law for MoI overtime is limited in the field of its compensation - by paying and additional paid leave, but it is not limited as the quantity of overtime which can be worked by employees. These are prerequisites for violation of fundamental constitutional rights - the remuneration for work regulated by law.
The solution of the problem can be found in two directions - to limit/restrict the overtime work regarding the compensations fixed in the Law for MoI or to eliminate all restrictions/limitations of all overtime compensations.
2.4. Eliminate the discrimination against police officers who are part-time graduated in the Academy of MoI.
Currently, all students on full-time training automatically assigned a category D after their graduation in Academy of MoI. Meanwhile, the students who have graduated part-time training in the Academy of MoI to acquire a category D, they have to compete and follow the general line and procedures. Furthermore - if the competition is for promotion in the category, the employees who have category E cannot participate in it, despite the fact that they have graduated the Academy of MoI and have the same major and degree as full-time graduated.
The change in this aspect, except it will terminate the established forms of discrimination will also justify the resources which MoI invest in means the part-time training staff in the Academy of MoI.
2.5. Provide functional immunity of trade union activists.
The Federation wants in the chapter twentieth of Law for MoI to be regulated (if necessary - by the modification or derogation of other provisions) the prohibition for service's termination of members in the elected management bodies of trade unions in accordance with Art. 245, item 13, as well as their transfer or posting for more than 90 days, during they are at this position in the trade union and six months after they are released, without the agreement of the central trade union's leadership.
TUFEMIs proposal is supported by the ratified from Republic of Bulgaria Convention of the International Labour Organisation, where is written the trade union leaders have immunity against prosecution and unfair dismissals. Such is the European practice.

The main goal of TUFEMI is defending and protecting fundamental socio-economic and occupational interests and rights of its members in the field of labor, employment, labor and business relations, social and health insurance, safety, support, ensuring a high standard of living and professional realization in accordance with the Constitution of the Republic of Bulgaria, the national and European legislation, conventions of the International Labour Organization and other international agreements to which the Republic of Bulgaria is a party, as well as the provisions of this Statute.
TUFEMI was resolutely opposed to corruption, deficit of justice and disinterestedness of the system for internal security state in the country.
TUFEMI will fully defend its objectives related to :
Effective enforcement of the European Charter of policemen in Bulgaria;
Well considered and precisely pursued reform with the result – achieving greater efficiency in the Ministry of Interior, without leading to unscrupulous cuts of operating units;
Changes in the philosophy of the Law on the Ministry of Interior in order to optimize the activities of law authorities and social status of the employees.
Improving working conditions in the structural units of the MoI. Sufficient limit of official cars, office computers, normal offices and furniture. Technical provision of specialized and regional directorates of the MoI.
Legal protection of the employees of the MoI in the performance of their duties (inviolability of the employee, real power of the employees in the use of special tools and physical force, incentives and pensions for the families of the officers, perished in the performance of their official duty, etc.).
To achieve these objectives, the Federation has the following tasks:
negotiating and concluding agreements with the employer within the system of the MoI, the appointing authority and the executive authorities;
concluding collective labour agreements with employers and collective agreements with the appointing authority;
union protection in the field of labor, employment, labour and insurance relations and individual rights;
organization of campaigns of union solidarity and protest actions;
providing material, moral, legal and other specialized assistance to its members and their families;
research and adaptation of labor and social legislation to the standards and practices of the European Union;
development of national and international programs and projects in the field of industrial relations, business relations, social insurance, employment, education and training, income and living standards, human resources development and social integration;
establishing and maintaining connections with similar unions in Bulgaria and abroad, cooperation in order to exchange experience and mutual assistance, participation in national and international trade forums;
representation and protection of its members to the employer, appointing authority, the executive and the judiciary, state and municipal administration, social, political and other organizations on issues of labor, social and health insurance and living standards;
laying down demands on the employer and the appointing authority to ensure conditions for rest and recreation of the Federation members;
conduct of cultural, educational and charitable activities;
organizing and realization of other activities under this Statute, which does not contradict the existing legislation;
participation in international events related to the activity of TUFEMI;
Interaction with organizations in the country and abroad, who share the values and goals of TUFEMI.
